Terms of Service: Product Safety, Installation, and Liability

1. Installation and Use Requirements
Rally Tally products must be installed and used strictly according to the instructions provided with the product and on our website. For the Rally Tally scorekeeper, this includes applying it only to a clean, dry, flat paddle handle end, removing any existing butt cap if present, and pressing it firmly in place for at least 30 seconds before use. The Pickle Grip must be fully secured beneath an overgrip. Products must not be modified, cut, re-glued with other adhesives, or attached to any surface other than the intended location.

2. Inspection Before Every Use
You are responsible for inspecting the product before each use to confirm that it is securely attached. If a product is loose, damaged, or not fully adhered, you must stop using it immediately and reattach or replace it before playing.

3. Assumption of Risk
Pickleball and other paddle sports involve inherent risks, including risks from equipment. By purchasing or using Rally Tally products, you acknowledge these risks and voluntarily assume all risks arising from the installation, use, or misuse of the products, including the risk that an improperly attached product could detach during play.

4. Responsibility for Others
If you install a Rally Tally product on a paddle that someone else uses, or give the product to another person, you are responsible for ensuring it is properly installed and for sharing these instructions and warnings with that person.

5. Disclaimer of Warranties
Except as expressly stated by us in writing, and to the fullest extent permitted by law, Rally Tally products are provided "as is," without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

6. Limitation of Liability
To the fullest extent permitted by law, Rally Tally and its owners are not liable for any injury, damage, or loss, whether to persons, paddles, equipment, or property, resulting from improper installation, failure to follow instructions, failure to inspect the product before use, modification, misuse, or use of the product in a manner not intended. In no event will Rally Tally's total liability for any claim exceed the amount you paid for the product.

7. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Rally Tally and its owners from any claims, damages, or expenses, including reasonable attorneys' fees, arising from your improper installation, misuse, or modification of the product, or from your failure to follow the instructions and warnings.

8. Your Legal Rights
Nothing in these terms limits any rights you may have under applicable consumer protection laws that cannot be waived.
